Terms of Service
These Terms of Service (“Terms”) govern your use of GetSpin360 (“we,” “us,” “our”), including our website at getspin360.com and our Shopify app. By installing or using GetSpin360, you agree to these Terms.
1. The Service
GetSpin360 provides two offerings:
- Capture tool — a mobile web app that lets you photograph your products and embed an interactive 360° viewer in your Shopify store.
- Professional photography service — you ship your product to us and we return a ready-to-publish 360° viewer within approximately 3 business days.
2. Subscriptions and Billing
GetSpin360 is a subscription service billed monthly through Shopify. Subscription fees are based on the number of monthly visitors to your 360° viewers. Your current plan and billing are managed through the Shopify admin.
You may cancel at any time through the Shopify app store. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.
3. Professional Photography Service
When using the professional photography service, the following terms apply:
- Shipping to us — you are responsible for packaging and shipping your product to us. We are not responsible for damage or loss that occurs during transit to our studio.
- Damage in studio — we handle all products with care, but GetSpin360 is not liable for any damage, loss, or deterioration that may occur during the photography process.
- Return shipping — if you would like your product returned, you must include a prepaid return shipping label with your shipment. If no return label is included, we will donate or responsibly recycle the product after the shoot.
- Turnaround — we aim to complete shoots within 3 business days of receiving your product. This is an estimate and not a guaranteed deadline.
4. Your Content
You retain ownership of all product images and content you create or upload using GetSpin360. By using the service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you.
You are responsible for ensuring you have the rights to any product you photograph or ship to us.
5. Acceptable Use
You agree not to:
- Use GetSpin360 for any unlawful purpose.
- Attempt to reverse-engineer, scrape, or interfere with our systems.
- Upload content that infringes third-party intellectual property rights.
- Resell or sublicense access to the service without our written permission.
6. Termination
We reserve the right to suspend or terminate your access to GetSpin360 at any time if you violate these Terms, with or without notice. You may terminate your subscription at any time through the Shopify admin.
7. Disclaimer of Warranties
GetSpin360 is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
8. Limitation of Liability
To the fullest extent permitted by law, GetSpin360 and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.
10. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page with a revised effective date. Continued use of the service after changes constitutes acceptance of the updated Terms.
